If your divorce is uncontested, you and your spouse can draft a marital settlement agreement that resolves all of these issues and submit the agreement to the judge for approval. If there are any issues you cannot agree on, the court will need to hold a hearing, listen to arguments and review evidence from both sides, and make a binding decision on the matter.
